Welcome to AirBaton! These Terms of Use (“Terms”) explain the rules that apply when you use any AirBaton website, app, or digital platform, including airbaton.com and airbaton.net (together, the “Platform”).

By using the Platform, you agree to these Terms and to our Privacy Policy.

1. General Use

AirBaton provides digital promotions — such as rebates, sweepstakes, loyalty programs, and other rewards — on behalf of brands and partners. You agree to use the Platform only for lawful purposes and in a way that respects the rights of others and the integrity of our programs.

You agree not to:

• Provide false information or create multiple or fake accounts;

• Attempt to cheat, game, or interfere with any AirBaton promotion;

AirBaton may, at any time and in its sole discretion, request proof of your identity, eligibility, or compliance with these Terms or any promotional rules.

3. Fraud, Misuse, and Bans

AirBaton takes fraud and abuse seriously. We reserve the unrestricted right to suspend, restrict, or permanently ban any user or account — with or without notice and for any reason we deem appropriate, including (but not limited to):

• Fraudulent activity or suspected fraud;

• Creation of multiple accounts or false identities;

• Abuse of promotions, offers, or rewards;

• Harassment, offensive behavior, or abuse toward our team or partners; or

• Any conduct that violates these Terms, applicable law, or the spirit of fair play.

Decisions regarding account or participant bans are final. If your account is banned, you may lose access to all current and past promotions, rewards, or balances without compensation.

AirBaton also reserves the right to deny access or remove any user from any promotion, campaign, or website at its sole discretion, even without a specific violation.

4. Promotions and Campaigns

Each AirBaton promotion (such as a sweepstakes, rebate, or loyalty program) may have its own Official Rules or Terms. Those rules will govern participation in that specific promotion.

If a conflict exists between these Terms and the Official Rules of a promotion, the Official Rules will apply for that promotion.

5. Intellectual Property

All content, code, and design on the Platform — including trademarks, graphics, text, and logos

— belong to AirBaton or our partners. You may not copy, reproduce, or reuse any part of the Platform without our written permission.

6. Limitation of Liability

The Platform is provided “as is” and “as available.”

AirBaton makes no guarantees about the operation, security, or accuracy of the Platform or any promotions hosted through it.

To the fullest extent allowed by law, AirBaton and its affiliates are not liable for any damages of any kind arising from your use or inability to use the Platform, including loss of data, profits, or participation privileges.

7. Indemnification

You agree to defend and hold harmless AirBaton, its affiliates, and partners from any claims, damages, or losses arising from:

• Your use or misuse of the Platform;

• Your violation of these Terms or any promotion rules; or

• Your infringement of any rights of another person or entity.

8. Termination and Changes

AirBaton may update, suspend, or discontinue any part of the Platform at any time without notice. We may also modify these Terms when needed — the date above will always reflect the most recent version. Your continued use of the Platform means you accept any changes.

9. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Any disputes will be resolved exclusively in the state or federal courts located in St. Louis County, Missouri.
